This document sets out the Terms & Conditions (the “Agreement”) for clients engaging with Encor and participating in services facilitated through our platform. By confirming participation, you (the “Client”) acknowledge that you have read, understood, and accepted the following terms, and agree to be bound by them in full.

  1. Introduction

Welcome to Encor Group. By accessing or using our services, you agree to be bound by these Terms and Conditions. These terms apply to all users of our platform, services, and website, including clients, partners, and third parties. If you do not agree with these terms, you should not use our services.

  1. Eligibility and Onboarding

To become a Client with Encor, you must:

  • Be of legal age in your jurisdiction of residence
  • Complete the onboarding and registration process
  • Provide all documentation required for Know Your Customer (KYC) and due diligence checks
  • Accept these Terms and Conditions in full

Participation in any service is subject to final review and approval by Encor and/or its partners. Encor reserves the right to reject any applicant or revoke access at its discretion, without obligation to provide a reason.

  1. Service Participation

Each service Encor offers will have specific terms and requirements, which will be outlined in individual Service Summaries or Overviews. These include but are not limited to:

  • Minimum requirements for service engagement
  • Payment instructions
  • Deadlines for required documentation or actions

Failure to meet these requirements may result in disqualification from the service. Encor retains the discretion to decline any application or suspend access at any time, without the obligation to provide a reason.

  1. Legal Documentation

All services may require full execution of legal documentation before participation is confirmed. These may include:

  • Service agreements or contracts
  • Compliance or regulatory forms
  • Local jurisdiction forms (if applicable)

These documents will be provided in accordance with the laws of the country or jurisdiction where the service is structured. Encor is not responsible for delays or penalties resulting from a Client’s failure to complete documentation on time.

  1. Rights and Obligations

Rights, obligations, and any applicable fees will vary depending on the service, jurisdiction, and legal structure. Clients are responsible for ensuring that they comply with all relevant laws, regulations, and obligations associated with the service they participate in.

Clients acknowledge that:

  • Encor’s role is to assist with the provision of services, not to offer financial, legal, or business advice.
  • All legal, tax, and financial implications are the responsibility of the Client, and we strongly recommend that Clients seek independent professional advice before making any decisions.
  1. No Financial or Investment Advice

Encor does not offer financial, investment, or business advice. Our services are focused on providing support for business expansion, market entry, and compliance with local laws and regulations. We do not guarantee any financial returns or outcomes, and Clients should seek independent professional advice for any financial, investment, or business-related decisions.

 

  1. Refunds, Cancellations & Withdrawals

Once a Client has committed to a service and all required documentation and payments have been processed, participation is considered final.

  • Refunds are not guaranteed and may only be considered in exceptional cases, such as a service not proceeding due to unforeseen circumstances.
  • Cancellation by the Client after confirmation may result in forfeiture of fees or amounts already transferred.
  • Withdrawal from a service after it has been initiated may not be possible, depending on the legal structure and governing jurisdiction.

All refund or withdrawal requests will be reviewed on a case-by-case basis.

 

  1. Risk Acknowledgment

By participating, the Client acknowledges the following:

  • Services may carry inherent risks depending on jurisdiction, legal obligations, and market conditions.
  • Encor does not guarantee any financial outcomes, nor does it make representations about the specific success or failure of services.
  • Changes in market conditions, regulatory environments, or other external factors may impact the service’s performanzce.

Clients are solely responsible for assessing their own risk tolerance and making informed decisions.

  1. Referral Program

Encor may offer a referral program where clients or partners can earn rewards for referring new clients to our services. The following applies:

  • Referral rewards (if any) are contingent on successful onboarding and completion of service requirements by the referred party.
  • All referrals must be disclosed prior to the referred party engaging in any transactions or actions.
  • Rewards are disbursed according to the terms communicated in the referral program and may vary based on the jurisdiction or service structure.
  • Abuse of the referral program may result in disqualification or termination of account access.

Referral programs are promotional in nature and may be amended or withdrawn at any time without prior notice.

  1. Data Privacy & Security

Encor is committed to upholding high standards of data protection across all jurisdictions.

  • Personal data is collected and processed solely for onboarding, service execution, compliance, and communication purposes.
  • Data is stored securely using encr ypted systems and restricted access controls.
  • Encor does not share client data with third parties except where necessary to comply with legal requirements or to deliver the requested services.
  • Clients may request access, correction, or deletion of their personal data in line with applicable data protection laws (e.g., GDPR, CCPA, or equivalents).

Use of the Encor platform constitutes consent to the collection and use of personal information as described in the Privacy Policy, which is available upon request or via the platform.

  1. Communications

All formal communication between Encor and the Client shall occur through the email address or platform portal used at registration. It is the Client’s responsibility to keep their contact information current and to regularly check communication channels for updates, deadlines, and instructions.

  1. Amendments to Terms

Encor reserves the right to amend these Terms & Conditions at any time. Updates will be published on the platform or communicated directly. Continued use of the platform or participation in any new service constitutes acceptance of the revised Terms.

  1. Governing Law & Jurisdiction

These Terms are governed by the laws of the country or jurisdiction in which the relevant service is executed, or as stated in the corresponding agreement. Any disputes shall be handled in accordance with the dispute resolution procedures outlined in the individual service documentation.
